How to File

An application for antidumping duties, countervailing duties, and/or a temporary safeguard can be made in writing to the ADSC by or on behalf of any domestic industry in Jamaica that may be experiencing injury due to dumping, subsidization, or a surge in imports.

After the application has been received, the ADSC will advise the applicant if sufficient evidence has been received to initiate the investigation.

In order to satisfy the requirements for initiation, applications must provide information and sufficient evidence to:

  • Prove dumping, subsidisation and/or a sudden increase in imports is occurring
  • Establish the material injury that the industry has suffered, or is likely to suffer;
  • Demonstrate how the dumped goods have caused, or are likely to cause material injury.
  • Show your application has support from the domestic industry

Business Confidential Information

A successful application to investigate dumping, subsidisation, or temporary safeguard measures requires specific information from manufacturers/producers. Understandably, some producers may have concerns about sharing this information with their competitors. In such cases:

  • A request can be made for confidential treatment of the information. Any request for confidential treatment must be accompanied by the reasons that confidentiality is being requested, as well as a non-confidential summary of the information. 
  • The Applicant is required to submit a confidential version and a non-confidential or public version of the complaint which can be shared with and viewed by interested parties as is relevant to the presentation of their case.

Submission

The Applicant is required to submit the typed complaint document as a paper original plus 10 copies and also in electronic form.

Please note that our Technical Staff offers advice and training on preparing the application for an investigation. However, they cannot complete the application for an industry.
