I. OVERVIEW

The Anti-dumping and Subsidies Commission (ADSC or the Commission), Jamaica’s Trade Remedies Authority is a portfolio agency of the Ministry of Industry, Investment and Commerce (the Business Ministry). The Commission was established in 1999 under the Customs Duties (Dumping and Subsidies) Act, to investigate complaints of dumped or subsidized imports that have caused, are causing or threaten to cause injury to producers of like goods in Jamaica. Under the Safeguard Act 2000, the Commission is appointed as the investigating authority to investigate complaints of surges in the volume of imports that have caused, are causing or threaten to cause serious injury to the domestic producers of like or directly competitive goods in Jamaica. The Commission delivers capacity building in the form of Pre-Filing Consultations, Training and Public Education for industry, industry advisors and the public to assist them to understand and utilize the trade remedies regime.

II. NATURE AND SCOPE

Under the general direction of the Executive Director, the Legal Counsel is responsible for all relevant functions necessary to evaluate and inform the Commission of its obligations under law and to advance the Commission’s compliance with all relevant laws. The purpose of the Legal Counsel is to provide the full range of activities in the areas of legal advice, legal representation and technical guidance. The legal advice must be founded on domestic law, principles of natural justice, and international law principles and practices to ensure that all the Commission’s communications, documentation, practices and procedures are legally compliant with its responsibilities as a quasi- judicial body. The legal representation and technical guidance will encompass the development and implementation of the legal framework, strategies, plans, policies and procedures regarding the adjudicative processes of the Commission.

III.  DUTIES AND RESPONSIBILITIES

  • Advise the Commission in a timely manner concerning its legal rights and obligations and take appropriate action to secure the Commission’s activities and ensure that the Commission acts according to law.
  • Provide legal advice on the interpretation and application of governing legislation, regulations and
  • Represent the Commission and manage the process of defending the Commission’s interests and position in litigation before local courts and international tribunals.
  • Take a lead role in the development of the legal framework, adjudicative processes and investigative practice of the Commission, taking into account the best practices of the Commission and of other jurisdictions, WTO jurisprudence and relevant Public International Law.
  • Review the current laws, liaise with appropriate stakeholders, provide drafting instructions to the Chief Parliamentary Counsel or prepare draft comments and amendments as necessary.
  • Draft all necessary legal and case related documents including briefs, opinions, decisions, requests for confidential treatment, Statements of Reasons, notes, pleadings, and correspondence.
  • Promote the enhancement of Jamaica’s jurisprudence in Trade Remedies and related areas by identifying areas for training and providing training for the Commissioners and Staff on legal issues relevant to the Commission’s

  • Coordinate the preparation of case and other Staff documents of the Commission as
  • Draft, review and revise administrative and legal documents of the Commission including the Commission’s contracts, correspondence with legal implications, or other documents.
  • Perform ISO 9001:2015 assigned responsibilities and prepare relevant documents for maintenance of the Commission’s quality management system.
  • Attend meetings, prepare reports and deliver oral and written presentations on issues related to the Commission’s mandate in the domestic and international fora, including trade associations, academic settings, negotiations or other meetings, as required.
  • Provide legal advice in the formulation of international trade policy and negotiating
  • Identify and advocate as appropriate, for the resources required by the Commission to effectively carry out its mandate and make recommendations in the budget process.
  • Provide legal advice and guidance to of the Staff and Board of Commissioners in relation to management and administrative matters.

V. PERFORMANCE STANDARDS

VI. QUALIFICATIONS, KNOWLEDGE & EXPERIENCE REQUIRED

  • Bachelor of Laws (LL.B.) Degree from a recognized
  • Master of Laws (LLM) Degree in International Trade Law or a related discipline is preferred but not
  • Legal Education Certificate (LEC) from the Norman Manley Law School or another Council of Legal Education-accredited institution.
  • Admission to the Jamaican Bar – must be a practicing attorney registered with the General Legal Council of
  • Membership and good standing with the Jamaican Bar Association
  • Minimum 3–7 years of post-qualification experience in corporate law, litigation, regulatory compliance, or a related legal field.
  • Experience in legislative review, contract drafting, corporate governance, and risk management is
  • Knowledge of Jamaican laws, regulations, and court procedures relevant to the
